The incident took place on June 22 at about 1:30 a.m. in the area of Thunderbird and Cheyenne Roads.
James Fowler, 46, of Apple Valley was drinking with his two sons ages 15 and 22 before the incident. Sheriff’s spokeswoman Jackie Alban said that Fowler was heading westbound on Thunderbird Road. His 15-year-old son was inside the vehicle while the 22-year-old son was in the bed of the truck.
Alban said that all three of them had been drinking.
