Tristan Shelton Arrested, Guillermo Cortez and Deshia Lane Injured in Fatal DUI Crash on Highway 140 in Atwater
ATWATER, CA (May 4, 2019) – A man was killed following a DUI hit-and-run crash Saturday morning in Atwater.
The victim has been identified by the Merced County Sheriff’s Office as Devon Fontenette-Noack, 20, of Winton.
Around 6:54 a.m., Tristan Shelton, 19, of Merced, was driving eastbound on Highway 140 at Sultana Drive in a 2006 Ford Focus with Fontenette-Noack and two other individuals, 18-year-old Guillermo Cortez of Atwater and 19-year old Deshia Lane of Los Banos, at about 75 mph.
The car veered left into the westbound lane and continued into a dirt field off the north shoulder of the highway, where it rolled over several times before landing on its wheels, according to a news release.
First responders found Fontenette-Noack unresponsive in the driver’s side back seat and pronounced him dead at the scene.
Fontenette-Noack was the only passenger not wearing a seat belt.
Cortez and Lane suffered minor injuries but refused medical aid.
Officers saw Shelton fleeing the scene on foot and arrested him on suspicion of vehicular homicide, driving while under the influence and felony hit-and-run resulting in death.
Shelton was transported to Mercy Medical Center with minor injuries before being booked in Merced County jail. He remained in custody Monday with bail set at nearly $300,000.
Investigation of this fatal crash is still ongoing.
