2-Year-Old Boy Dies, Jose Arvizu Malagon Involved in DUI Crash on Edison Road and Sunset Boulevard
Bakersfield, CA (August 3, 2020) – On Saturday, a 2-year-old boy died after he was run over by Jose Arvizu Malagon in a DUI crash east of the Edison Road and Sunset Boulevard intersection.
The California Highway Patrol said the fatal crash happened at about 4:12 p.m. in the driveway of a residence southeast of Lamont.
The 31-year-old Jose Arvizu Malagon drove his 2019 Chevy Traverse to check on his goats in the far southeast corner of his property, officers said.
He didn’t see the child in the driveway. As a result, he struck the boy as he drove forward.
The child, whose name has not been released, was taken to Kern Medical, where he was later pronounced dead.
Police arrested Malagon after determining he was driving under the influence.
We at Sweet Lawyers express our heartfelt condolences to the bereaved of the child. Our thoughts are with you in this time of pain.
The Aftermath of Untimely Death
It is clear now more than ever that one person’s negligence can have devastating effects on other individuals. This is quite common in accidents that result in death.
It is crucial that the family of the victim know that they have the authority to file a wrongful death suit.
A wrongful death suit allows families to hold parties liable for the irrevocable damages they have caused.
In a word, it is a claim brought against a defendant who has caused someone’s death, either through negligence (i.e. drunk driving) or as a result of some intentional action.
